The placement of an order confirms that you have read and accept the following agreement:
THE AGREEMENT
This agreement is between K WALLACE WEDDING SCRAPBOOK DESIGN CO. (hereinafter referred to as “the company”) and the purchaser (hereinafter referred to as “the client”) and is effective at the time of purchase.
The company agrees to receive photographs, either in the form of a CD or copies of the client's actual photographs, as well as other memorabilia, from the client for the purpose of creating a custom-designed scrapbook. While in the possession of the company, every safeguard will be used to protect all forms of media received from the client for this purpose. However, the client agrees to hold harmless the company for any damage, either minor or catastrophic, caused to the photographs and/or memorabilia while in the possession of the company.
The client acknowledges that s/he has seen samples of artwork created by the artists/technicians of this company and agrees to accept the artistic interpretations, i.e., formatting and arrangements of client’s photographs and other memorabilia, by said artists/technicians, as they are designed by them for the purpose of creating a scrapbook of the client’s photographs and memorabilia.
The accuracy of information provided by the client for the purpose of “journaling” on any and all scrapbook pages (the printed narrative which may accompany a photograph or other memorabilia for the purpose of identifying said photo or its content) is solely the responsibility of the client, and the company assumes no responsibility for such accuracy. The company, however, will correct at its cost, any errors that may occur in transmitting such information onto the scrapbook page(s).
A 15% DISCOUNT will be extended to any client for a signed model release which will give the company the right to create and maintain electronic copies of any and/or all of the scrapbook pages prepared for this client for the express purpose of generating a portfolio of electronic images which may, at the discretion of the company, be used to promote the company through advertising of all media forms, including, but not limited to posting on electronic galleries and websites.
The cost of preparing a custom-designed scrapbook by the company, including all materials, is $400.00, 50% of which is due before the creation of the scrapbook will commence. The remaining 50% is due upon the completion of the album, but before delivery of the completed project to the client. Payment may be made through PayPal® on the company’s website (kwallaceweddingscrapbookdesignco.com) or by personal check or money order made payable to the company.
Delivery of the completed scrapbook will be made within 5 days of receipt of the funds from PayPal® into the company’s PayPal® account, or when your personal check clears your bank. Delivery will be made using UPS® standard delivery, insured for the project cost and at the expense of the company, except where the delivery address is outside of the 48 contiguous states. Shipment, including insurance, to addresses outside of the 48 contiguous states will be made at an additional cost to the client. The company is not responsible for loss or damage of the completed scrapbook in transit; however, either the insured value will be paid to the client or the scrapbook will be replaced.
